ZEGAHABESHA TERMS OF SERVICE

Welcome to ZegaHabesha, operated by My2 Commercial Solutions Inc. referred to below as "ZegaHabesha," "us," "we," or "Company". These ZegaHabesha Terms of Service also referred to below as "Terms" govern your use of the ZegaHabesha services, accessible globally and managed from Canada. Please read these Terms carefully before creating an account. By using the ZegaHabesha services (the "Services"), you agree to these Terms, including our Privacy Policy and Cookie Policy. If you do not agree with any of these Terms, do not access and do not use the Services.

 

1. INTRODUCTION

Agreement to Terms: These Terms constitute a legally binding agreement between you and ZegaHabesha. Your use of the Services constitutes your agreement to these Terms, regardless of whether you are a registered user.

 

Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of changes by updating the "Effective Date" at the top of these Terms. Some changes may be communicated via email. Your continued use of the Services after such modifications constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services.

 

2. ACCOUNT ELIGIBILITY: YOUR RESPONSIBILITIES

2.1. Eligibility: By using the Services, you represent and warrant that you are at least 18 years old, legally qualified to contract, not located in an embargoed country, not on a prohibited list, not prohibited by law from accessing or using the Services, and you have not been convicted of a severe criminal offense. You also agree to comply with all applicable laws while using the Services.

2.2. User Responsibilities: You agree to follow these Terms and to respect the rights of others. You are responsible for maintaining the security of your account and for any activity that occurs under your account.

2.3. Prohibited Activities: You agree not to misuse the platform, engage in fraudulent or harmful activities, harass or violate the rights of others, post prohibited content, or violate any licenses. You agree to comply with our Safety Tips and maintain a strong password.

 

3. PROHIBITED CONTENT

3.1. Content Restrictions: Our dating community maintains strict guidelines to ensure a safe and respectful environment for all members. You must refrain from posting, uploading, or transmitting any content that is offensive, harassing, obscene, abusive, discriminatory (including homophobic), illegal, defamatory, untrue, related to commercial activities, contains harmful code, violates rights, or exploits minors.

3.2. Zero Tolerance Policy and Termination of Services: Any violation of these content guidelines will result in immediate termination of your access to our platform without refunds. We enforce a zero-tolerance policy to uphold the integrity of our community. By using our Services, you implicitly agree to adhere to these guidelines. If you do not agree, we kindly ask that you refrain from using our platform.

3.3. Prohibition of Child Sexual Abuse and Exploitation (CSAE)

Our platform maintains a strict prohibition against all forms of child sexual abuse and exploitation (CSAE). We operate under a zero-tolerance policy towards any content or activity that promotes or facilitates CSAE.

In-App Mechanism for User Feedback

To ensure a safe and supportive environment, we offer an in-app mechanism for users to provide feedback, raise concerns, or report any suspicious activity, including instances related to CSAE. Users can utilize various channels such as a contact form, live chat support, or the reporting tool available on a member's profile.

Addressing Child Sexual Abuse Material (CSAM)

Should any instance of Child Sexual Abuse Material (CSAM) be reported or detected, swift action is taken to confirm and address the issue. We have a process in place to report confirmed CSAM to the relevant national or regional authority. Furthermore, we promptly remove both the content and the responsible publisher from our platform, adhering to our established standards and relevant legal requirements.

 

4. CONTENT

4.1. Your Content: By using the Services, you may submit content, which remains your responsibility. You grant ZegaHabesha a worldwide license to use, store, reproduce, and share your content as necessary to provide the Services.

4.2. Member Content: You agree to respect the ownership of member content and only use it as allowed by the owner.

4.3. Our Content: All content provided by ZegaHabesha remains the property of ZegaHabesha.

 

5. INAPPROPRIATE CONTENT AND MISCONDUCT REPORTING

5.1. Community Standards: ZegaHabesha does not tolerate inappropriate content or misconduct on the platform. We are committed to maintaining a positive and respectful community.

5.2. Reporting: If you encounter inappropriate content or behavior, please report it via a profile or email at contact@cnnekt.com. For copyright concerns, refer to Section 12 (Digital Millennium Copyright Act).

 

6. PRIVACY

6.1. Your Privacy: We value your privacy. Your use of the Services is subject to our Privacy Policy, which outlines how we collect, use, and disclose your data.

6.2. Data Use: By using the Services, you agree to the data practices outlined in our Privacy Policy.

 

7. RIGHTS BY ZEGAHABESHA

7.1. Service Usage: You are granted the personal, non-exclusive right to use the Services in compliance with these Terms and applicable laws.

 

8. RIGHTS YOU GRANT ZEGAHABESHA

8.1. Ownership: You retain ownership of the content you submit to the Services.

8.2. License: By creating an account, you grant ZegaHabesha a worldwide, non-exclusive license to use, store, reproduce, and share your content. This license is non-exclusive except for derivative works created through the Services.

8.3. Protection of Content: You authorize ZegaHabesha to take measures to protect your content when used outside the Services.

8.4. Advertising: You acknowledge and agree that ZegaHabesha has the right to display advertising on the Services.

8.5. Feedback: Any feedback you provide may be used by ZegaHabesha without compensation to you.

8.6. Access and Disclosure: ZegaHabesha may access and disclose your account information and content if required by law.

 

9. PURCHASE AND RENEWING SUBSCRIPTIONS

9.1. Purchase and Subscription: You may purchase products, services, or subscriptions through the Services. Subscriptions may renew automatically unless canceled.

9.2. External Service Purchases: If you purchase through External Services, you must manage your purchases and subscriptions through those services. Subscriptions will renew until canceled.

9.3. Internal Purchases: If you purchase through the App, your subscriptions will renew until canceled. You authorize ZegaHabesha to charge your Payment Method for subscription fees.

 

10. VIRTUAL ITEMS

10.1. Limited-Use Features: You may purchase limited-use features known as "Virtual Items" through the Services.

10.2. Non-Refundable : Virtual Items are non-refundable, subject to specific conditions outlined in these Terms.

10.3. License and Ownership : Virtual Items represent a license, not ownership. ZegaHabesha reserves the right to manage, regulate, and modify Virtual Items.

10.4. Transfers and Sales: Transferring or selling Virtual Items to others is prohibited.

 

11. REFUNDS

11.1. General Refund Policy: Generally, purchases are non-refundable. No refunds will be provided for partially used periods unless local laws allow.

11.2. Subscription Cancellation: You may cancel a subscription within 3 business days for no penalty.

11.3. Refunds Upon Death or Disability: In cases of subscriber death before the subscription ends, the estate is entitled to a refund for the remaining period. Refunds may also be applicable in case of disability.

 

12. INSTALLMENT PLAN CONDITIONS

12.1. Installment Plan: If you opt for an installment plan, specific terms apply. Eligibility, payment, and cancellation terms are outlined.

12.2. Payment Authorization: By choosing the installment plan, you authorize periodic charges on your chosen Payment Method.

12.3. Termination: ZegaHabesha may terminate installment plans for payment issues.

 

13. ACCOUNT TERMINATION

13.1. Account Deletion: You may delete your account anytime through the App's "Settings."

13.2. External Service Purchases: To avoid extra billing, manage External Service Purchases.

13.3. Suspension and Termination: ZegaHabesha may suspend or terminate accounts for violations of these Terms. No refunds will be provided for terminated accounts.

 

14. NO CRIMINAL BACKGROUND CHECKS

14.1. User Conduct: ZegaHabesha does not perform criminal or identity checks on users. Users should exercise caution and follow Safety Tips.

 

15. DISCLAIMER

15.1. Service "As Is": ZegaHabesha Services are provided "as is" and "as available." No warranties, including accuracy or uninterrupted use, are provided.

15.2. User Responsibility: You use the Services at your discretion and risk. ZegaHabesha is not responsible for user content or conduct.

 

16. DIGITAL MILLENNIUM COPYRIGHT ACT

16.1. Copyright Infringement: ZegaHabesha follows the Digital Millennium Copyright Act (DMCA) for copyright complaints.

16.2. DMCA Takedown Notice: To report copyright complaints, submit a DMCA Takedown Notice containing the required information.

16.3. Termination: ZegaHabesha may terminate the accounts of repeat infringers.

 

17. ADS AND THIRD-PARTY CONTENT

17.1. Display of Ads: ZegaHabesha may display ads on the app, similar to other subscription services.

17.2. Third-Party Content: Services may contain third-party ads, promotions, and links. ZegaHabesha is not responsible for external content or services.

 

18. LIMITATION OF LIABILITY

18.1. Limited Liability: ZegaHabesha's liability is limited by applicable law. ZegaHabesha is not liable for indirect or consequential damages.

18.2. User Conduct: ZegaHabesha is not responsible for the conduct of users or third parties.

 

19. DISPUTE RESOLUTION

19.1. Contact Customer Service: Before pursuing claims, contact ZegaHabesha's Customer Service.

19.2. Arbitration: Arbitration is the exclusive means of dispute resolution. Some exceptions apply, and no class actions or representative proceedings are allowed.

19.3. Enforcement: If the arbitration agreement is upheld, enforcement may occur in court.

 

20. GOVERNING LAW

20.1. Applicable Law: Canadian law and the Federal Arbitration Act govern disputes. Canadian law applies to disputes, except where prohibited.

 

21. VENUE

21.1. Litigation Venue: Non-arbitrated claims are litigated in Calgary, Alberta. Small claims court exceptions are allowed.

 

22. INDEMNITY BY YOU

22.1. Indemnification: You agree to indemnify ZegaHabesha for claims arising from your use of the Services.

 

23. ACCEPTANCE OF TERMS

24. ENTIRE AGREEMENT

24.1. Superseding Agreement: These Terms, along with our Privacy Policy, Cookie Policy, and Additional Terms, constitute the entire agreement between you and ZegaHabesha.

25.1. State-Specific Terms: Specific terms apply to subscribers in certain states/provinces.

 

26. REFUNDS UPON DEATH OR DISABILITY

26.1. Refunds in Special Cases: Subscribers' estates may be entitled to refunds upon death or disability.

 

27. APP STORE COMPLIANCE

27.1. App Store Guidelines: ZegaHabesha is committed to complying with the guidelines set forth by the app stores where it is available, including but not limited to the Apple App Store and Google Play Store.
